Monash exclusion appeal: deadline and first steps
Rule checked against Monash University's own pages on .
If Monash has excluded you, an appeal must be served on the secretary to the exclusion appeals panel within 20 working days after the date that service of the exclusion notice is taken to have been effected. First, read your exclusion letter and the notice of appeal form published on the University website, then serve that form on the secretary. If you failed to appear at, and submit evidence to, the academic progress committee hearing, the regulations say you have no right of appeal but may apply in writing to the dean for re-consideration within 20 working days after the date that service of the exclusion notice is taken to have been effected.
- Time limit to appeal
- An appeal against exclusion must be served within 20 working days after the date that service of notice of the exclusion decision is taken to have been effected.[1]
- Grounds you can use
- You can appeal only on two grounds: new evidence that was not reasonably available at the time of the academic progress committee hearing and had the potential to affect its decision, or a procedural irregularity that had the potential to affect its decision.[1]
- Where to submit
- Serve a notice of appeal, in the form published on the University website, on the secretary to the exclusion appeals panel.[1]
- Studying during an appeal
- An excluded student remains a student while they have any right of appeal, and if they serve a notice of appeal, until the appeal process is concluded. The regulations do not say whether they may enrol in units during that time.[1]
Check your exclusion letter first
If Monash has excluded you, read the exclusion letter before you do anything else. The appeal deadline runs from the date that service of notice of the exclusion decision is taken to have been effected. The regulations say notice of the academic progress committee's decision and reasons must be served on the student not more than 10 working days after the decision. Check the letter for the decision, the reasons and the date service is taken to have happened. Keep a copy of the letter and any message or envelope that came with it.
If you are a double degree student, the regulations say exclusion under this regulation is from both degrees. If you failed to appear at, and to submit evidence to, the academic progress committee hearing, read the section below on that situation before you use the appeal form.
What to do first
Do these steps in order.
- Read your exclusion letter and note the date service of the exclusion notice is taken to have been effected. That date is the starting point for the 20-working-day period.
- Check whether you failed to appear at, and to submit evidence to, the academic progress committee hearing. If you did, the regulations say you have no right of appeal but may apply to the dean for re-consideration.
- If you are appealing, get the notice of appeal form published on the University website. The regulations say the appeal is made by serving that form on the secretary to the exclusion appeals panel.
- Serve the notice within 20 working days after the date that service of notice of the exclusion decision is taken to have been effected. The regulations also mention an extended period determined by the President of the Academic Board in circumstances the President regards as exceptional. The pages we read do not say how to ask for that extension.
- Keep copies of the form and anything you send. Contact MGA Advocacy service or Student Advocacy & Support (SAS), listed under Free help at this university, if you want help with the process.
The only two appeal grounds
Your right of appeal is limited to one or both of two grounds. The first is that new evidence exists that was not reasonably available to you at the time of the academic progress committee hearing and had the potential to affect the committee's decision. The second is a procedural irregularity that had the potential to affect the committee's decision. Your appeal needs to fit at least one of those grounds. A reason outside those grounds is not within the stated right of appeal.
Read your true evidence against the ground you rely on. Gather documents you already have and keep copies of what you submit. Do not change a document or create a new record of past events. The pages we read do not define procedural irregularity, so ask Monash or the free advocacy service what the panel will consider if that is your ground.
If you failed to appear at the hearing
The regulations say a student who fails to appear at, and to submit evidence to, an academic progress committee hearing has no right of appeal but may apply to the dean for re-consideration. The application must be made in writing and served on the dean within 20 working days after the date that service of notice of the exclusion decision is taken to have been effected. That is a different route from the exclusion appeals panel. The pages we read do not state a form for re-consideration, so ask Monash how to make the written application.
What happens while the appeal is on foot
The regulations say an excluded student remains a student while they have any right of appeal, and if they serve a notice of appeal, until the appeal process is concluded. The regulations do not say whether they may enrol in units during that time. Ask Monash before you rely on enrolling.
The pages we read do not set out the panel's steps or timeframes after the notice is served. Ask the secretary to the exclusion appeals panel or the free advocacy service what happens next. If the appeal goes against you, the pages we read do not state what you can do after that decision. Read the decision and ask Monash or the free advocacy service listed under Free help what options apply.
