UTS exclusion appeal: deadline, grounds and steps

Rule checked against University of Technology Sydney's own pages on .

If UTS has excluded you, lodge a written appeal through ASK UTS within 20 working days of the date of notification of the decision. The appeal must specify and substantiate one of the allowed grounds: procedural irregularities likely to have a significant negative impact on the decision, mitigating circumstances supported by documentary evidence that directly and significantly affected your performance, or factual errors of such magnitude that they invalidate the decision. Check the date on your notice and read your letter and the UTS page before you submit.

Time limit to appeal
An appeal against exclusion must be lodged within 20 working days of the date of notification of the decision.[1]
Grounds you can use
Grounds are procedural irregularities likely to have a significant negative impact on the decision; mitigating circumstances supported by documentary evidence that directly and significantly affected performance; or factual errors of such magnitude that they invalidate the decision.[1]
Length of exclusion
If you are excluded for not meeting minimum progress or failing subjects (E2F/E3F), you are withdrawn from all admitted courses and excluded from further UTS study for one academic year, counted from the original exclusion notice.[2]
Where to submit
Lodge the exclusion appeal by submitting an online enquiry through ASK UTS.[2]
Studying during an appeal
After you submit the appeal, you can keep provisional enrolment until an outcome is reached, which includes paying fees and charges, attending required learning activities and doing all assessment.[2]
Coming back later
You must complete the full year of exclusion from the date of your original exclusion notice before applying to any course at UTS.[2]
If you're on a student visa
If you are an international student and do not appeal, or your appeal is unsuccessful, UTS must report this to the Department of Home Affairs.[2]

UTS exclusion appeals have a 20-working-day limit. The appeal must be lodged within 20 working days of the date of notification of the decision. Working days, not calendar days, count. The clock starts from the date of notification.

Check the notice and the date

Read the exclusion notice and find the date of notification. That date starts the 20-working-day period. Keep the notice and any covering email. If you are not sure what decision you have, ask ASK UTS or the UTS Students' Association.

Lodge a written appeal through ASK UTS

  1. Start the appeal in writing. The rule says it must specify and substantiate the grounds.
  2. Use the appeal cover page and a letter to the Director, Student Administration that the official page lists.
  3. Lodge the appeal by submitting an online enquiry through ASK UTS.
  4. Keep a copy of the appeal and the confirmation you receive.

You need to lodge the exclusion appeal even if you have also applied for a review of a result, a course transfer, course withdrawal, leave of absence, or remission, refund or withdrawal from subjects without academic penalty. Those applications do not replace the exclusion appeal.

Use one of the three grounds

The rule allows three grounds. A procedural irregularity must be in the decision-making process and of a type and to an extent likely to have a significant negative impact on the decision. Mitigating circumstances must be supported by documentary evidence and must have directly and significantly affected your performance. A factual error must be of such magnitude that it invalidates the decision. The official page says your letter should explain circumstances beyond your control, show how they affected your academic progress, and outline steps you will take to improve your academic performance, including strategies, support services or changes you plan to make. Use true evidence only.

What happens after you lodge

After you submit the appeal, you can keep provisional enrolment until an outcome is reached. That includes paying fees and charges, attending required learning activities and doing all assessment. You cannot make changes to your enrolment while your exclusion sanction is active, such as course or subject withdrawal, subject enrolment, or acceptance of an offer or admission to a new course. The Director, Student Administration refers the appeal to the relevant Responsible Academic Officer, and the appropriate Course Director or equivalent considers it first. The pages we read do not state how long the appeal will take; ask ASK UTS if you need an update. You will receive the outcome at your UTS email address and at your external email address if you provided one. If the appeal succeeds, the exclusion sanction is lifted and you can continue your studies. If your exclusion was for not meeting the minimum rate of progress, you will be placed on academic caution for the next half year of study.

If the appeal is unsuccessful

Read the outcome notice. For exclusion for not meeting minimum progress or for E2F or E3F, you must complete the full year of exclusion from the date of your original exclusion notice before applying to any course at UTS. Standard application procedures apply. Readmission is not automatic, and you should seek guidance from your faculty about work or study programs that you can undertake to improve your chances of readmission. For exclusion for failure to complete course requirements in the prescribed time, you may apply for a different course at UTS while the prescribed course time exclusion is active. Exclusion from the sanctioned course is permanent, and you may not apply for readmission to that course at any point. You can talk to the UTS Students' Association, listed under Free help.
